For toy products exported to the United States, the following tests are generally required: (including but not limited to)

  • ASTM F963-17 Physical & mechanical test
  • ASTM F963-17 Flammability test
  • ASTM F963-17 Soluble heavy metals
  • ASTM F963-17 / 16 CFR 1303 / CPSIA Total lead in surface coating
  • CPSIA Total lead in substrate
  • CPSIA Phthalate + CA Prob65 Phthalate
  • NERC - Toxic elements in packaging
  • CPSIATracking label
  • Original Country Label
  • Net Contents

The U.S. laws and regulations are very strict and detailed. The above is only a partial list of mandatory test terms. Specific recommendations for test entries need to be given by the laboratory based on physical samples. If your product contains art materials, they also need to undergo the TRA (toxicological analysis) test.

  

3.1 CPSIA

“The Consumer Product Safety Improvement Act” has the following requirements for the safety testing of children's products.

  

               CHILDREN'S PRODUCT SAFETY

Sec. 101. Children's products containing lead; lead paint rule.
Sec. 102. Mandatory third-party testing for certain children's products.
Sec. 103. Tracking labels for children's products.
Sec. 104. Standards and consumer registration of durable nursery products.
Sec. 105. Labeling requirement for advertising toys and games.
Sec. 106. Mandatory toy safety standards.
Sec. 107. Study of preventable injuries and deaths in minority children related to consumer products.
Sec. 108. Prohibition on sale of certain products containing specified phthalates.

3.1.3 Tracking Label

All tracking labels must contain certain basic information, including:

  • Manufacturer or private labeler name; (No self-coding)
  • Location and date of production of the product; (Self-coding)
  • Detailed information on the manufacturing process, such as a batch or run number, or other identifying characteristics; and any other information to facilitate ascertaining the specific source of the product. (Self-coding)

All tracking label information should be visible and legible.

3.1.4 ASTMF963

Sec. 106 of the CPSIA regulations directly references ASTM F963: 

Sec. 106. MANDATORY TOY SAFETY STANDARDS.

(a) IN GENERAL — Beginning 180 days after the date of enactment of this Act, the provisions of ASTM International Standard F963-07 Consumer Safety Specifications for Toy Safety (ASTM F963), as it exists on the date of enactment of this Act (except for section 4.2 and Annex 4 or any provision that restates or incorporates an existing mandatory standard or ban promulgated by the Commission or by statute) shall be considered to be consumer product safety standards issued by the Commission under section 9 of the Consumer Product Safety Act (15 U.S.C. 2058).

3.1.5 Federal Regulation 19CFR134

The famous mark "Made in China" is from the federal regulation 19CFR134: Original Country Label. This regulation is so well known that many customers do not arrange for testing.
  

3.1.6 FPLA/UPLR

Fair Packaging Act, such as content list, name, etc.
  

3.1.7 State regulations

If your product needs to be sold in California and/or Illinois, the following state regulations also need to be tested.
  • CA Prob 65 lead & Phthalates / California 65 lead and o-benzene
  • Illinois Lead / Illinois Lead
There may be other state regulations that require additional testing. For example, Washington and Vermont flame retardant and CHCC testing. Please consult the laboratory for details.
  

3.1.8 Risk Warning

  • Testing at the federal regulatory level (above the state level) is mandatory. Customers are advised not to omit them.
  • State regulation level is subject to availability.
  • Specific test entries need to be determined by the laboratory based on actual samples. The test provisions mentioned above are only commonly used provisions.
